Pool legislation

As of 1 January 2017, the Fencing of Swimming Pools Act 1987 is no longer in effect.

Legislation relating to pool barriers and pool fencing is now included in the Building Act 2004.

It now requires Council to inspect all pools across the district every 3 years to make sure they meet the requirements of the Act.

The primary focus to to make sure that pools are safe for children under 5 years.

The inspection fee is $150 which will be invoiced when the pool is deemed to be fully compliant. If there are still issues identified after the second inspection you could be liable for a $1000 infringement fine. 

If your pool is consented but does not have a Code Compliance Certificate you may be able to save on the 3 yearly inspection costs by requesting a final inspection and gaining a Code Compliance Certificate.
